Terms of Service

1. Acceptance of These Terms

These Terms of Service (the “Terms”) are a legal agreement between you and Fuentes Digital Ventures LLC (“we”, “us”, or “our”), a Wyoming limited liability company, and govern your access to and use of the KetoSnap AI: Carb Scanner app and related services (the “Service”). These Terms also serve as an End User License Agreement (EULA), except that, for the Apple App Store version of the app, Apple's Standard End User License Agreement applies (see Section 8). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Accounts

The Service works without an account. You do not sign up, log in, or provide an email, name, or password to use it. We automatically create an anonymous identity for your app install. You may optionally set a display name, but it is not required. You are responsible for activity that takes place through your device.

3. License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Service for your own personal, non-commercial use on devices you own or control, in accordance with the applicable app store terms.

You agree that you will not:

• Reverse engineer, decompile, or disassemble any part of the Service, except where this restriction is prohibited by law
• Copy, modify, distribute, sell, sublicense, or create derivative works of the Service
• Scrape, harvest, or use automated means to access or extract data from the Service
• Circumvent, disable, or interfere with usage limits, security, or other features
• Use the Service to build a competing product or to train competing models
• Use the Service in any unlawful, harmful, or abusive way

4. Description of the Service

KetoSnap AI lets you take a photo of food, or scan a packaged product barcode, and receive an AI-generated keto score and macro estimates (carbohydrates, protein, fat, and calories). Every new user gets 2 free AI food scans (lifetime). After that, scanning and AI recipe generation require a Premium subscription.

5. AI and Health Disclaimer

Consult a qualified healthcare professional before making dietary decisions, especially if you have a medical condition, are pregnant, or have food allergies or intolerances. Do not rely on the Service for emergencies or for diagnosing, treating, or preventing any disease. Your use of the information provided by the Service is at your own risk.

6. Acceptable Use and Fair Use

You agree to use the Service only for its intended purpose and not to abuse, overload, or manipulate our AI features. Scans and recipe generation are subject to fair use limits that help us keep the Service reliable and prevent abuse.

7. Subscriptions, Billing, and Cancellation

• Free tier: Every new user receives 2 free AI food scans (lifetime). After that, scanning and AI recipes require Premium.
• Plans: KetoSnap AI Premium is offered as a Monthly plan at USD 5.99 and an Annual plan at USD 59.99. Prices may vary by region and store, and the current price is shown at the time of purchase.
• Free trial: Premium may include a 3-day free trial as an introductory offer (one per Apple or Google subscription group). If you do not cancel before the trial ends, your paid subscription begins automatically.
• Auto-renewal: Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
• How to cancel: Manage or cancel your subscription in your Apple ID (iOS) or Google Play (Android) account settings. We do not cancel subscriptions for you, and deleting the app does not cancel your subscription.
• Restore purchases: You can restore an active subscription on another device using “Restore Purchases” in the app, via your Apple or Google account.
• Payments and refunds: All payments are processed by Apple or Google, not by us. We do not issue refunds directly; refunds are handled by Apple or Google and are subject to their policies. We never receive or store your payment card details.

8. Apple Standard EULA

If you downloaded the app from the Apple App Store, in addition to these Terms, Apple's standard Licensed Application End User License Agreement applies, available at apple.com/legal/internet-services/itunes/dev/stdeula. You acknowledge that these Terms are between you and Fuentes Digital Ventures LLC only, not with Apple or Google, and that Apple and Google have no responsibility for the Service or for providing support. Apple and Google are third-party beneficiaries of these Terms and may enforce them.

9. Your Content

You keep ownership of the photos you submit. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, and transmit your photos, including sending them to our AI providers, solely to operate and provide the Service to you.

10. Intellectual Property

The Service and its content, features, and functionality, including the KetoSnap and KetoSnap AI names and logos, are owned by Fuentes Digital Ventures LLC and are protected by intellectual property laws. Except for the license granted above, these Terms do not give you any right in our intellectual property.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate, including the accuracy of keto scores, macros, or recipes.

12. Limitation of Liability

To the maximum extent permitted by law, Fuentes Digital Ventures LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of, or inability to use, the Service. To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve (12) months before the claim, or USD 50.

13. Indemnification

You agree to indemnify and hold harmless Fuentes Digital Ventures LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or of any law or third-party right.

14. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or misuse the Service. You may stop using the Service at any time and may delete your data as described at /delete-account. Sections that by their nature should survive termination will survive.

15. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the courts located in the State of Wyoming, unless applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms from time to time. We will update the date at the top, and for material changes we will provide notice in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.
